Federal Government Unveils New Framework for Online Pharmacies

The Federal Government of Nigeria has launched the Electronic Pharmacy Regulations 2026. This is a comprehensive regulatory framework aimed at strengthening oversight, improving medicine safety. Most notably, it will help in formalising Nigeria’s rapidly expanding digital pharmaceutical market.

The new regulations, which replace the 2021 framework, were officially unveiled in April 2026 by the Federal Ministry of Health and Social Welfare. They are designed to address growing concerns around counterfeit medicines, weak supply chain controls, and unregulated online drug distribution.

A Technology-Driven Law for Digital Pharmaceutical Services

The Electronic Pharmacy Regulations 2026 now serve as the primary legal framework governing digital pharmaceutical operations in Nigeria. It seeks to ensure a safe, transparent, and accountable online drug market while supporting innovation and access to essential medicines.

By tightening compliance requirements and clarifying operational standards, the regulations position digital pharmacy services as a regulated extension of Nigeria’s healthcare delivery system.

Four Clear Registration Pathways with PCN

Under the new framework, operators must register with the Pharmacy Council of Nigeria (PCN) through one of four defined pathways:

  • Physical Premises + Infrastructure: For entities operating a licensed physical pharmacy alongside their own online platform.
  • Physical Premises + Aggregator: For physical pharmacies that rely on third-party digital platforms.
  • Online Infrastructure + Partnership: For operators without a physical store but with a formal partnership with a licensed retail pharmacy.
  • Aggregator + Partnership: For entities with neither a physical pharmacy nor proprietary platform, provided they have both an aggregator agreement and a licensed pharmacy partner.

These pathways are designed to accommodate different business models while maintaining accountability and patient safety.

Core Compliance and Professional Oversight

Key compliance requirements under the 2026 regulations include:

  • Superintendent Pharmacist: Every registered online pharmacy and aggregator must appoint a licensed Superintendent Pharmacist responsible for all pharmaceutical services.
  • Prescription Verification: Prescription-only medicines (POMs) may only be dispensed after verification of a valid prescription issued by a healthcare practitioner licensed in Nigeria.
  • Prescription Validity: Prescriptions are valid for six months and must include the prescriber’s Nigerian physical address, contact details, registration number, and signature.
  • ROPSE Display: Registered platforms must prominently display the Registered Online Pharmacy Sites Emblem (ROPSE) as proof of legitimacy.
  • Refill Controls: Strict limits apply to refill quantities and prescribed refill intervals to prevent abuse and misuse.

Strengthening Safety, Traceability, and Access

The regulations also introduce robust internal operational and safety standards:

  • Storage and Logistics: Medicines must be stored and transported under appropriate temperature-controlled conditions.
  • Digital Traceability: Platforms are required to maintain digital records to track medicine sources and ensure supply chain integrity.
  • Reproductive Health Access: The framework permits the online advertisement and sale of selected family planning products with OTC waiver status, improving access to essential reproductive health services.

Non-compliance may result in licence suspension or revocation, heavy fines, or criminal prosecution under the PCN Establishment Act.

Government: A Milestone in Healthcare Regulation

Speaking at the launch in Abuja, the Permanent Secretary of the Ministry, Daju Kachollom, represented by the Director of Hospital Services, Abisola Adegoke, described the regulations as a major milestone.

She said the framework emerged from extensive collaboration with technology innovators, healthcare providers, and legal experts. It carefully balances accessibility, security, and accountability in the digital health ecosystem.

PCN and Health Ministry Emphasise Enforcement and Partnership

The Registrar of the Pharmacy Council of Nigeria, Ibrahim Ahmed, noted that the COVID-19 pandemic exposed serious regulatory gaps in online pharmacy operations.

According to him, the 2026 regulations establish a comprehensive legal and technical framework for the registration, licensing, operation, and supervision of digital pharmaceutical services nationwide.

Also speaking, the Coordinating Minister of Health and Social Welfare, Muhammad Pate, said the policy forms part of broader reforms to organise Nigeria’s healthcare market and attract investment.

He stressed that compliance would be met with regulatory partnership, while violations would face strengthened enforcement. The new regulation will help in reinforcing trust and transparency in Nigeria’s medicine distribution system.
